CRANE OPERATOR’S PETITION FOR RESTORATION DENIED FOR FAILING TO COMPLY WITH CONDITIONS SET BY THE COMMISSION

   Longshoreman Kevin Westcott, 33, of Staten Island, New York, whose registration was revoked for five months in 2015 for possession of crack cocaine and for fraud, deceit or misrepresentation, had his petition for restoration denied today by the Commission.

   Westcott’s registration was revoked for five months following an administrative hearing in 2015 when the Commission established that he was in possession of a quantity of crack cocaine in April 2014 for which he had been arrested by the New York City Police Department on Staten Island.

   When he was interviewed by the Commission following his arrest, Westcott denied using cocaine; however, a drug test showed cocaine in his system. The Commission subsequently revoked his registration for five months and placed several conditions on his return, including actively participating and completing drug addiction counseling and not committing any new crime or offense.

   Today, the Commission found that Westcott had failed to provide proof that he completed drug addiction counseling required for restoration and that he had been arrested in June 2016 for Assault in the Third Degree for repeatedly punching his own brother him in the face, causing injuries, including a swollen eye and laceration. Therefore, the Commission determined that Westcott had failed to comply with two of the conditions for restoration of his registration following his original revocation and denied his petition.
